Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and Fire Pump Simulator Inc. (“Fire Pump Simulator,” “we,” “us,” or “our”), an Ontario corporation, and govern your access to and use of our website, training simulator, and related services (the “Service”). Please read them carefully.

1. Acceptance

By creating an account, signing in, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and have the legal capacity to enter into a binding contract to use the Service. By using the Service, you represent that you meet these requirements.

3. Your account

You are responsible for the accuracy of the information you provide when you create your account, for keeping your credentials confidential, and for all activity that occurs under your account. Notify us at support@firepumpsimulator.com if you suspect any unauthorized use of your account.

4. The Service

Fire Pump Simulator is a software-based training tool that simulates fire pump operations, hydraulics, and water-source configurations. We may update, change, or discontinue features of the Service at any time.

5. Training disclaimer — read carefully

The Service is provided for educational and training purposes only. It is not a substitute for hands-on training, certified instruction, departmental standard operating procedures, NFPA standards, or the judgment of a qualified pump operator or fireground commander.

Do not rely on the Service for live fireground decisions, hydraulic calculations in active emergencies, or as a primary means of certifying competency. You are solely responsible for verifying any technique, calculation, or configuration against authoritative real-world sources before applying it operationally.

You retain ownership of the scenarios, apparatus configurations, hydrants, line configurations, nurse units, static sources, and other content you create in the Service (“Your Content”). You grant Fire Pump Simulator a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and process Your Content solely as needed to operate, secure, and improve the Service. You represent that you have all rights necessary to grant this license.

8. Our intellectual property

The Service, including its software, simulation models, design, content, and trademarks, is owned by Fire Pump Simulator Inc. and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal training purposes subject to these Terms. We reserve all rights not expressly granted.

9. Pricing

The Service is currently offered at no cost. We may introduce paid features in the future and will provide reasonable advance notice through the Service or by email before any new charges apply to you.

10. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms, if your use poses a risk to the Service or its users, or if we are required to do so by law. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.

11. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation. We do not warrant that the Service will be error-free, that defects will be corrected, or that the simulation reflects real-world conditions with any particular degree of accuracy.

12. Limitation of liability

To the maximum extent permitted by law, Fire Pump Simulator Inc. and its directors, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or training opportunity, arising out of or related to your use of the Service, whether based in contract, tort, strict liability, or any other theory, even if we have been advised of the possibility of such damages.

Our aggregate liability for all claims arising out of or related to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) CAD $100.

13. Indemnification

You agree to defend, indemnify, and hold harmless Fire Pump Simulator Inc. and its directors, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of the rights of any third party.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the effective date at the top of this page and, where appropriate, provide additional notice through the Service. Your continued use of the Service after the updated Terms take effect constitutes acceptance of the changes.

15. Governing law and venue

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-laws principles. You and Fire Pump Simulator Inc. agree that the courts located in Ontario, Canada will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to the personal jurisdiction of those courts.

16. Miscellaneous

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Fire Pump Simulator Inc. regarding the Service. If any provision is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce a provision is not a waiver of our right to do so later. You may not assign these Terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
